On March 21st, it was learned from the Ministry of Public Security that in recent years, public security organs across the country have focused on criminal activities such as off exchange capital allocation and illegal investment consulting. They have persisted in cracking down on illegal securities and futures business crimes in accordance with the law, continuously carrying out full chain and all-round crackdowns, successfully investigating and cracking down on a number of key cases, effectively deterring crime, effectively maintaining the order of the capital market, and effectively protecting the legitimate rights and interests of investors. On March 21st, the Ministry of Public Security announced five typical cases of illegal securities and futures business crimes. Illegal business case involving Li and others. In August 2022, the Jiading Branch of the Shanghai Public Security Bureau lawfully filed and investigated a case involving Li and others suspected of illegal business operations. According to the investigation, from 2015 to 2022, in order to seek benefits, the suspect, Mr. Li and Mr. Jiang, without the qualification for securities margin trading, raised funds and publicly solicited customers for capital allocation, and provided them with capital allocation funds for securities trading at a leverage ratio of 1:1 to 1:5, and charged interest per month according to the amount of capital allocation. As of the time of the incident, Li and Jiang provided off-site funding totaling over 740 million yuan to clients in the above-mentioned manner, illegally profiting over 11 million yuan. In August 2024, the Shanghai First Intermediate People's Court sentenced Li and other defendants guilty of illegal business operations and imposed fines. Xie Mouping and others are suspected of illegal business operations. In May 2024, the Public Security Bureau of Suqian City, Jiangsu Province, lawfully filed and investigated a case involving Xie Mouping and others suspected of illegal business operations. It is found that since June 2023, the suspect Xie Mouping and Wang Mouqiang, together with others, have registered accounts in several futures companies as parent accounts without the approval of the relevant departments, and then split the parent accounts into thousands of virtual sub accounts. In this way, they have privately built futures trading platforms, engaged in illegal futures brokerage business, and collected transaction fees. As of the time of the incident, Xie Mouping, Wang Mouqiang and others have developed more than 6300 clients, involved in huge transaction amounts, and illegally profited more than 85 million yuan. At present, 29 suspect of Xie Mengping have been arrested and brought to justice, and the case has been transferred to the procuratorial organ for review and prosecution. Wang Mouhao and others are suspected of illegal business operations. In September 2024, the Yuhui Branch of the Bengbu Public Security Bureau in Anhui Province lawfully filed and investigated a case involving Wang Mouhao and others suspected of illegal business operations. After investigation, the suspect Wang Mouhao and Huang Mouming set up an over-the-counter funding platform to illegally operate the over-the-counter funding business without obtaining the securities business operation qualification. The criminal gang recruited customers through online and offline means, and provided them with 3 to 10 times leverage for stock trading. As of the time of the incident, Wang Mouhao and others have used the platform to solicit more than 4700 customers and provide funding of over 420 million yuan. At present, four suspect including Wang Mouhao have been arrested and brought to justice, and the case has been transferred to the procuratorial organ for review and prosecution. Wang Mouzeng and others are suspected of illegal business operations. In March 2024, Longhua Branch of Shenzhen Public Security Bureau in Guangdong Province lawfully filed and investigated a case involving Wang Mouzeng and others suspected of illegal business operations. According to the investigation, since 2023, the suspect Wang Mouzeng and others have registered and established an asset management company without obtaining the relevant futures business operation qualification, solicited customers online, lured customers to open accounts through the futures trading software they provided, and carried out illegal futures investment consulting services in the form of sales trading courses, live broadcast of substitute teachers, etc., with the transaction amount involved more than 50 million yuan. At present, 16 suspect including Wang Mouzeng have been arrested and brought to justice, and the case has been transferred to the procuratorial organ for review and prosecution. Jin Mouben and others are suspected of illegal business operations. In August 2024, the Tianhe Branch of Guangzhou Public Security Bureau in Guangdong Province lawfully filed and investigated a case involving Jin Mouben and others suspected of illegal business operations. Through investigation, since 2023, suspect Jin Mouben and others have opened a company and set up small programs and live broadcast rooms to provide illegal securities investment consulting services under the cover of selling ordinary commodities without obtaining relevant securities business operation qualifications and securities investment consulting qualifications. The gang arranged for "lecturers" to teach stock knowledge in the live broadcast room, attracting viewers to buy ginseng wine, ginseng powder and other products at high prices and obtaining recommended stock codes and buying and selling prices. As of the time of the incident, the transaction amount involved in the case exceeded 30 million yuan. At present, 7 suspect including Jin Mouben have been arrested and the case has been transferred to the procuratorial organ for review and prosecution. (New Society)
