Controversy over Selling Charging Parking Spaces in New Residential Areas to Lead to Installation of "Piles"

When the Rongyu Phase II community in Tongyun Street, Tongzhou District went on sale, charging parking spaces were sold for a full 30000 yuan more than ordinary parking spaces. However, after moving in, the owners found that ordinary parking spaces could also apply for the installation of charging piles, and the extra 30000 yuan inexplicably became "wasted money". Later, in response to complaints about fire hazards caused by the installation of charging piles in ordinary parking spaces, the fire department issued a notice to the property management to rectify the situation within a specified period of time (hereinafter referred to as the "rectification letter") on the grounds that the fire prevention unit in the charging area of the underground garage was not effectively separated from other areas of the garage. Ordinary parking spaces equipped with charging stations were therefore 'disconnected and dismantled' due to power outages. The 'chaotic battle' that the community is currently experiencing has caused many to face long-term inconvenience in charging. Is there a solution to 'chaotic warfare'? Who should protect the interests of owners of charging and regular parking spaces? The reporter launched an investigation into this matter. Reflecting that the charging piles on ordinary parking spaces were "dismantled and cut off power", Rongyu Phase II is a newly built community with 1592 underground parking spaces, divided into charging parking spaces and ordinary parking spaces. Among them, there are 295 charging parking spaces, which are centrally arranged on the south side of the basement with complete power distribution facilities. However, the disadvantage is that they are far away from residential buildings on the north side and the price is 30000 yuan more expensive than ordinary parking spaces. Although the power distribution facilities in ordinary parking spaces are not as complete as those in charging parking spaces, according to relevant regulations, all charging facilities have been reserved for installation, and the distribution of parking spaces is also wider. After moving in, Mr. Zhang, the owner, installed a charging station in his regular parking space. He told reporters that since the fire department issued a responsibility reform letter to the property management of the community, not only him, but also other new energy vehicle owners who have purchased ordinary parking spaces in the community are facing charging difficulties because their charging piles have been disconnected and dismantled due to power outages. The developer once promised to install charging piles for ordinary parking spaces, especially since the basement of the community has already passed the fire safety inspection of relevant departments. How could there be a problem of non-compliance with the fire zone? "Mr. Zhang said in confusion. The property not only dismantled and cut off power to these charging piles, but also no longer accepts applications for new ordinary parking spaces to install charging piles. It has been nearly a year since the issuance of the responsibility reform document, and many homeowners have been appealing in multiple ways. During this period, they can only rely on the surrounding areas of the community or public charging stations to solve the charging problem. On the afternoon of May 15th, under the guidance of the owners, the reporter found multiple ordinary parking spaces equipped with charging piles on the north side of the underground garage in the community. Flipping the nearby power switch up and down, the status lights on the charging station panels did not light up, and the charging stations were in a power-off state. Above the parking spaces, there are vehicle license plates corresponding to each parking space. By comparing the vehicle license plates, it was found that many car owners holding new energy vehicle license plates have purchased ordinary parking spaces, and most of these parking spaces have not yet installed charging stations. The reply letter from the housing and construction department provided by the owner shows that on the deadline for rectification of the responsibility reform document, the property management of the community has removed some charging piles and taken power-off measures for the remaining charging piles. Despite working hours, there are already 6 cars charging at the 10 public charging spaces on the east side of the underground garage. A car owner said that it is the peak charging season after work at night, and it is difficult to find a public charging parking spot, so they chose to come here for charging in the afternoon off peak. In the WeChat group of the community, the reporter also saw that due to the shortage of public charging parking spaces, several homeowners have reported problems such as not moving their cars after fully charging, forcibly pulling out the charging gun, and irregular parking affecting the charging of other vehicles. Controversy 1: Is it reasonable to increase the price of charging parking spaces? Compared with the grievances of ordinary parking space owners who have been "dismantled and cut off power", owners who have purchased charging parking spaces also look frustrated. A homeowner told reporters that they were told by salespeople that there were no charging parking spaces downstairs, and ordinary parking spaces could not be equipped with charging piles. That's why they spent an extra 30000 yuan to purchase a charging parking space further away from their home. Nowadays, some people can buy nearly a lot of parking spaces for less money and even install charging stations. "Didn't the owners of charging stations waste their money?" In interviews, multiple community owners confirmed that the cause of the charging station installation dispute originated from the community developer. Ordinary parking spaces are priced at 300000 yuan each, while charging parking spaces are priced at 330000 yuan. In the process of purchasing parking spaces, different owners obtain a wide variety of information from the developer. Some homeowners have been informed that charging stations can also be installed in regular parking spaces, but they need to go through the relevant procedures themselves; Some homeowners have been informed that only charging stations can be installed in the charging parking spaces on the south side of the community. A homeowner provided the reporter with a PPT displayed by the developer during the parking space explanation, which clearly stated that according to relevant regulations, the installation conditions for charging piles are fixed ownership parking spaces and long-term tenants (with a lease term of one year or more). But when the reporter consulted the sales office of the community over the phone, the staff clearly stated that purchasing ordinary property rights parking spaces cannot install charging piles. "The reason why charging parking spaces are 30000 yuan expensive is because these parking spaces have the conditions to install charging piles." The chaos of information shows this. Previously, some owners who had purchased charging parking spaces consulted the 12345 hotline. Charging parking spaces are far away and expensive, and now both types of parking spaces can be equipped with charging piles. The developer is required to inform them of the differences between the two types of parking spaces and replace them with regular parking spaces, or sign an electric vehicle parking space recharge agreement. After verifying with the community developer Financial Street Holdings and China Wuyi Industrial Co., Ltd., the relevant departments in the locality have provided feedback that the charging parking spaces are invested in by the construction unit with meter boxes, superior cables, and cable trays, and reserved with meter boxes. The installation cycle, convenience, and conditions are different from non charging parking spaces, and sales personnel explain them according to unified requirements during the sales process. Is it reasonable to increase the price of charging parking spaces? Regarding this, property management lawyer Bao Hua believes that there is currently no pricing standard for the sale price of property parking spaces in this city. Developers can describe parking spaces as charging or regular when selling them. In the process of selling parking spaces, if the developer clearly states that charging parking spaces are scarce, that is, only charging parking spaces can install charging piles, and other parking spaces cannot be installed, but the owner finds that the actual situation does not match the developer's original promotion during the use of the parking space, then the developer is suspected of influencing the buyer's right to choose through misleading behavior. Buyers can protect their rights against this. Controversy 2: Is the fire responsibility reform document correct? According to the responsibility reform document issued by the Tongzhou District Fire Rescue Brigade to the property management of the community, the fire protection units in the charging area of some electric vehicles in the underground garage of the community have not been effectively separated from other areas of the garage, which does not comply with the provisions of 6.1.5 of the "Technical Standard for Electric Vehicle Distributed Charging Facilities Engineering" (GB/T51313-2018) (hereinafter referred to as the "Technical Standard"). The property management is ordered to make corrections before May 31, 2024. Some homeowners believe that this responsibility reform document contains many contradictions and is an incorrect one. Previously, we consulted with the housing and planning departments of Tongzhou District regarding the acceptance of the community and received a qualified response. ”A representative of the property owner said that the fire department's responsibility reform document not only contradicts the planning and acceptance results of the Tongzhou District Housing and Urban Rural Development Commission and the Planning and Self Discipline Bureau, but also has loopholes in the objects, referenced regulations, and rectification methods in the responsibility reform document. Some property owners believe that according to the provisions of the Standard Law of the People's Republic of China, mandatory standards must be implemented, and the adoption of recommended standards is encouraged. The "Technical Standards" referred to by the fire department is a recommended national standard. Even if implemented according to this standard, the fire zone is still a problem that existed in the early planning and construction of underground garages. The target of the responsibility reform letter is the property management unit of the community, not the property rights unit of the garage - the developer. How can a property management unit change the planning of the fire zone? On the day of the responsibility reform deadline, the property management completed the rectification by cutting off the power and dismantling the charging piles of ordinary parking spaces. However, when we installed these charging piles, we also followed the process of installing charging piles by the urban management committee step by step. This disposal method seriously damages our interests. There are several new communities in Tongzhou that are in the same situation as us, but they have not been 'cut off from power' by dismantling piles. According to the "Technical Standards", the maximum fire zone of underground garages with centralized charging facilities is not allowed to exceed 1000 square meters. At present, only the areas where charging parking spaces are located meet this standard in terms of area, so all ordinary parking spaces cannot install charging piles temporarily. The relevant departments have held several coordination meetings before, and we are also waiting for their final results, "said a staff member of the Tongzhou District Planning Department. Previously, when the planning department approved the underground garage of the community, the area where the charging parking spaces were located was centrally arranged. Although according to the Technical Standards, the maximum area of fire protection units in the centralized layout area of underground parking garages should not exceed 1000 square meters, the Technical Standards do not make clear requirements for the area of fire protection units in other reserved charging facility installation conditions. Therefore, we have judged that there is no problem with the current fire protection plan for the basement. However, the fire department's responsibility reform document has administrative effect. At that time, we also contacted the fire department to request the removal of the responsibility reform document or the issuance of a supplementary explanation with administrative effect to solve the problem, but they did not agree. "The staff of Tongzhou District Housing and Urban Rural Development Commission said that the property management of the community had cooperated with some ordinary parking space owners to install charging piles before, and whether they can continue to install charging piles in the future, the housing and urban development department also needs to wait for the fire department to give a clear result on whether the responsibility reform document is reasonable. The reporter learned that in response to the owners' feedback on whether the responsibility reform document is correct, the Beijing Fire and Rescue Corps is currently conducting a review and investigation, and it is expected to give a conclusion in the near future.
