Shaanxi Provincial Procuratorate and Provincial Audit Department Establish Six Collaborative Mechanisms to Promote the Integration and Coordination of Legal Supervision and Audit Supervision

Recently, the Shaanxi Provincial Procuratorate and the Provincial Audit Department jointly signed the "Mechanism for Cooperation and Cooperation between Legal Supervision and Audit Supervision" (hereinafter referred to as the "Mechanism"), establishing six specific mechanisms including consultation and contact, lead transfer, information sharing, business cooperation, collaborative supervision, and exchange and training, further expanding the scope of cooperation, standardizing cooperation methods, and promoting the integration and coordination of legal supervision and audit supervision. The Mechanism specifies the scope of clues that both parties should proactively transfer and the scope of information that can be requested. If the procuratorial organs discover clues of financial and revenue and expenditure violations of national regulations during the performance of their duties, they shall transfer them to the auditing organs. Audit institutions can be requested to provide information on public interest litigation, economic responsibility audits of state personnel, as well as relevant civil, administrative litigation, and enforcement cases that fall within the scope of prosecutorial supervision. Audit institutions found during audits that illegal acts by natural persons, legal persons, or other organizations, as well as illegal or non performance of duties by administrative organs, have resulted in infringement or risk of infringement of national and social public interests, or that administrative organs should have transferred suspected criminal clues but did not transfer them, or that judicial staff abuse their power and are suspected of job-related crimes, should be transferred to the procuratorial organs. The Mechanism requires both parties to convene joint meetings in a timely manner to discuss and resolve issues and promote work. To strengthen business collaboration and provide professional consultation and guidance to each other during the performance of duties; We need to identify the "small incisions" in fulfilling our duties, and jointly carry out special research or special actions to address prominent issues in key areas of social governance; To build a communication platform, promote mutual learning and exchange, and cultivate high-quality prosecutorial and auditing talents.
