Recently, the measures taken by two major platform companies have attracted social attention: Meituan announced the complete cancellation of overtime fines for crowdsourcing riders by the end of 2025 and the establishment of a "points based" positive incentive mechanism to replace punitive measures; JD pays five social insurances and one housing fund for full-time food delivery riders, and fully bears the social insurance and other expenses of about 2000 yuan per person per month. These changes reflect that platform enterprises are paying more attention to protecting the rights and interests of workers in the form of re employment. The platform economy is flourishing, and new forms of employment have become important channels for absorbing employment. There are 84 million riders, drivers and couriers employed on the Internet platform nationwide. They shuttle through the streets and alleys, connecting thousands of households and becoming an indispensable part of social development. Effectively strengthening the protection of the rights and interests of workers in new forms of employment is not only a "new test question" for economic and social development, but also a "must answer question" that requires detailed answers. It should be noted that the new form of employment, due to its flexible employment methods and loose organizational structure, has resulted in complex and diverse situations involving labor disputes, and there are many new challenges in protecting the rights and interests of workers. In 2024, more than 80000 civil cases involving new forms of employment will be concluded in the first instance by courts across the country, involving various aspects such as social insurance disputes, insurance contract disputes, and traffic accident liability disputes. For example, some companies try to avoid labor relations by signing contract agreements with workers and attempting to "cut corners" in protecting workers' rights and interests through "deceptive methods"; Some prioritize delivery efficiency over safety risks. The existence of these problems not only affects the sense of achievement of workers in new forms of employment, but also to some extent restricts the healthy development of the platform economy. Judicial rulings play an important role in guiding values. In recent years, the judicial authorities have established a "barometer" for the protection of workers' rights and interests by issuing authoritative cases, interpreting laws through cases, and clarifying rules. In a typical case released by the Supreme People's Court, a food delivery rider suffered infringement damage while performing work tasks. The court clarified that after receiving occupational injury protection benefits for new forms of employment, workers still have the right to request a third party to bear infringement liability in accordance with the law, and the two are not repeated. A judgment like this not only strengthens the occupational safety "protective net" at the individual case level, but also serves as a judicial demonstration and guidance for promoting the healthy and standardized development of new business models. To better safeguard the rights and interests of workers in new forms of employment, it is necessary to strengthen the responsibilities of all parties involved. On the one hand, relevant law enforcement and judicial departments should increase their efforts to crack down on acts that infringe upon the rights and interests of workers, open up channels for safeguarding their rights, and provide more accurate and convenient legal services for new forms of employment workers, helping those whose rights have been violated to obtain timely relief. On the other hand, platform enterprises should take on the main responsibility and optimize platform rules and algorithms to enable workers to work with dignity.
