In recent years, automobile finance leasing has become increasingly popular as an emerging consumption method, and related financial service activities have become increasingly active. However, criminals exploit these loopholes to seek profit. Recently, the procuratorate of Xigu District, Lanzhou City, Gansu Province, prosecuted 9 people including suspect Shi according to law for suspected contract fraud. In November 2020, Shi and Li, who had previously worked as loan intermediaries, learned that a certain financing leasing and car purchasing platform could handle vehicle financing leasing business, and smelled a "business opportunity" from it. The two of them contacted the owners of a motorcycle dealership, Wang A and Wang B, based on the information they saw about their cooperative car dealership on the platform. They also brought in six people, including Zhou, who had poor credit and no repayment ability, as "customers". The three parties conspired to commit fraud by fabricating the fact of purchasing a car. The three parties signed false motorcycle purchase and sale contracts, as well as financing lease and after-sale leaseback contracts. After the platform approved and released the purchase financing funds to the car dealership account, they did not actually purchase the car, and the car dealership did not deliver the vehicle. The financing funds were divided among Shi, Li, Zhou, and the car dealership according to the agreed proportion. After receiving the money, Zhou and other "customers" no longer returned the installment payments. According to statistics, Shi and 9 others have embezzled over 160000 yuan from the platform through this method. After receiving data collaboration clues from the Ministry of Public Security, the Xigu Branch of Lanzhou Public Security Bureau launched an investigation on October 20, 2023. On March 31, 2025, the case was transferred to the Xigu District Procuratorate for examination and prosecution. At the beginning of the case review, nine suspect refused to plead guilty and vigorously argued that this was just an ordinary "mortgage overdue dispute". The case handling prosecutor repeatedly studied the evidence materials, looked for clues from the chat records between suspect, analyzed the real intention behind the malicious interruption of confessions, and finally accurately determined that each suspect had the purpose of illegally occupying the financing funds for car purchase, fabricated facts and defrauded property in the process of signing and performing the contract. On June 24th, the court prosecuted 9 people including Shi for suspected contract fraud in accordance with the law. (New Society)
