In order to establish and improve a unified, standardized, collaborative, and scientifically efficient credit repair system, and better assist credit subjects in efficiently and conveniently reshaping their credit, the National Development and Reform Commission recently solicited public opinions on the "Credit Repair Management Measures (Draft for Comments)" (hereinafter referred to as the "Draft for Comments"). The draft for soliciting opinions clearly states that credit subjects have the right to credit repair in accordance with the law. Except for situations where laws, administrative regulations, local regulations, or policy documents of the Party Central Committee and the State Council clearly stipulate that it cannot be repaired, credit entities that meet relevant conditions can apply for credit repair as required. Specifically, dishonest information is classified and managed according to the severity of the dishonesty, and is generally divided into three categories: "minor, general, and serious". Different disclosure periods are set according to the principle of equivalent punishment. After the shortest public notice period expires, the credit subject can apply for credit repair according to regulations; After the longest public disclosure period expires and the credit subject corrects the dishonest behavior and fully fulfills the relevant obligations, the relevant information will automatically stop being disclosed. The publicity period starts from the date of the disclosure of the dishonest information. Among them, serious dishonest information includes administrative penalties such as revoking licenses, restricting production and business activities, ordering production and business suspension, ordering closure, and restricting employment; The information that has been included in the list of serious dishonest entities by relevant industry regulatory authorities in accordance with laws and regulations shall be publicly disclosed for a minimum of 1 year and a maximum of 3 years. The draft for soliciting opinions proposes that industry regulatory authorities may formulate specific classification standards for dishonest information in their respective fields based on the classification principles of "minor, general, and serious", and publish them uniformly on the "Credit China" website. Credit subjects applying for credit repair should provide relevant materials to the "Credit China" website. Credit repair methods include removing serious dishonest subjects from the list, terminating the disclosure of administrative penalty information, and removing from the abnormal list. (New Society)
