It is reported that on November 30, 2022, the Zhejiang Provincial High People's Court issued a document listing Jinhua Intermediate People's Court as a pilot court for the "Comprehensive Application of Digital Intelligence in the Reduction of Leave 2.0", and will carry out digital reform of commutation and parole in conjunction with Jinhua Prison in the province. A "two index" quantitative model was constructed to address the pain points of "difficulty in determining repentance performance" and "difficulty in assessing recidivism risk" in the trial of commutation and parole. The "repentance performance recognition index" dynamically assigns scores from two dimensions: the performance of criminal reform and the performance of criminal before imprisonment; The 'recidivism risk assessment index' sets 25 factors and 125 scenarios around four categories of factors: punitive, corrective, reparative, and individualized, achieving a leap from 'empirical judgment' to 'quantitative evaluation'. Jinhua, with the style of daring to explore, daring to try, and seeking truth from facts, has promoted the comprehensive digital and intelligent collaborative reform of reducing counterfeit goods from breaking the ice to deepening cultivation. ”Ye Xiangyang, Secretary of the Party Group and President of Jinhua Intermediate People's Court, introduced that after more than two years of practice, the "two index" model has completed the transformation verification of more than 10000 criminals, and a total of 3399 cases of reduced leave have been concluded, achieving 100% accuracy in legality review, 95% effectiveness review and matching with judges' case handling, and strengthening judicial fairness. It is understood that the clear composition of the "two indices" is like a precise "baton", which not only allows criminals to have a clear understanding of the specific requirements for commutation and parole, but also enables them to make precise efforts and actively reform, forming a virtuous incentive cycle of "better performance, higher scores, and greater opportunities". Moreover, through the guidance of "comparing oneself with oneself", it shifts from horizontal comparison between secondary offenders to vertical comparison among individuals, effectively stimulating the endogenous motivation for reform. Data shows that this mechanism has led to a 33 percentage point decrease in the violation rate of criminals in Jinhua Prison in Zhejiang Province, a 29 percentage point increase in the full compliance rate of property related judgments, and a 16 percentage point increase in the forgiveness rate of victims.
