Illegal sale of "laughing gas" for profit sentenced to two years in prison

Although nitrous oxide (N2O) can make people laugh briefly, it can cause great harm to the human body. Smoking and selling nitrous oxide is an illegal and criminal act that harms oneself and others, disrupts market order and social order. Recently, the People's Court of Chengdu High tech Industrial Development Zone in Sichuan Province made a judgment on a case of illegal operation of "laughing gas". The defendant Wang was sentenced and his criminal gains were recovered for selling "laughing gas" without a license for profit. Starting from January 2022, Wang purchased nitrous oxide cylinders from his previous company without obtaining a hazardous chemical business license, and sold them through social media platforms in Chengdu High tech Zone, Chenghua District, and other places at a price of 150 to 240 yuan per cylinder. At the end of January 2022, he hired Li to deliver goods to his doorstep and expand the scale of his business. After investigation, it was found that from November 2022 to April 2023, a total of 224400 yuan was transferred for gas purchase to just one upstream company; As of April 12, 2023, the total revenue from selling "laughing gas" in its payment transaction details was 8176900 yuan. On April 5, 2023, the public security organs intercepted Li, who was delivering goods, and seized a "laughing gas" cylinder on the spot; On April 11th, Wang was arrested, and after identification, it was found that the gas cylinder contained nitrous oxide, revealing the truth of the case. The public prosecution accuses Wang of violating national regulations by operating items restricted by laws and administrative regulations without permission, disrupting market order, and the circumstances are serious. He should be held criminally responsible for the crime of illegal operation in accordance with Article 225, Paragraph 1 of the Criminal Law. During the trial, Wang pleaded guilty and accepted punishment. The defense counsel requested lenient punishment on the grounds that he was a first-time offender, had returned 20000 yuan of stolen money, and had shown remorse. After comprehensive consideration, the court made a judgment: the defendant Wang committed the crime of illegal business operation and was sentenced to two years in prison and fined RMB 200000; Retrieve 180000 yuan of criminal proceeds and hand them over to the national treasury.
