Recently, the Shanghai Municipal Consumer Protection Commission commissioned the East China Sea Fisheries Research Institute of the Chinese Academy of Fishery Sciences to conduct testing and investigation on 15 popular domestic and foreign Antarctic krill oil products on the market. One of the products, labeled as "Beijing Tongrentang 99% high-purity Antarctic krill oil" with a phospholipid identification value of 43%, had a phospholipid content of 0 according to the test results. Experts say that Antarctic krill oil products should be shrimp oil extracted from Antarctic krill, which must contain phospholipid components. The manufacturer of this product is Anhui Habo Pharmaceutical Co., Ltd., and the distributor is Beijing Tongrentang (Sichuan) Health Pharmaceutical Co., Ltd. On December 15th, Beijing Tongrentang Health Pharmaceutical Co., Ltd. announced through its official service account "Tongrentang Health" that it would "immediately order Sichuan Health Pharmaceutical to stop distributing this product", and stated that the unauthorized use of the words "Beijing Tongrentang" on this product is suspected of being illegal. The company also announced that it has initiated judicial proceedings to prosecute the involved enterprise. According to the reporter's inquiry, the product suspected of ingredient fraud is still on sale on shopping platforms: it is prominently labeled as "Beijing Tongrentang" and uses the "Emperor" trademark held by Beijing Tongrentang (Sichuan) Pharmaceutical. Public information shows that Beijing Tongrentang (Sichuan) Health Pharmaceutical Co., Ltd. is a "subsidiary" of Beijing Tongrentang (Group) Co., Ltd. in China. The publicly available testing data has received widespread attention and raised concerns among consumers about the hidden dangers behind the "OEM" model of products. In industries such as pharmaceuticals, health products, and food, it is not uncommon for well-known brands to engage in "OEM". However, in order to facilitate sales, merchants often do not particularly emphasize that products are "OEM", so ordinary consumers are easily equated with products produced by the nominal brand manufacturer. This is also one of the most frequently criticized issues by consumers regarding the "OEM" model. Who should be responsible for any problems with the product, the brand owner or the actual producer? The approval number and packaging information of the above phosphorus shrimp oil product show that its legal identity is "gel candy" in the category of ordinary food. According to Article 21 of the Implementation Regulations of the Food Safety Law, if a food or food additive producer or operator entrusts the production of food or food additives, it shall entrust a producer who has obtained a food production license or a food additive production license to produce them, supervise their production behavior, and be responsible for the safety of the entrusted food or food additives.
