Digital mediation builds a 'heart bridge', and women's federations and courts join forces to break through the situation. A 'family photo' brings back the ten-year love story of impulsive divorced couples, opening the door to the expectations of the people and the direction of the law. Perhaps it is the confusion in the process of medical reimbursement, the confusion in the details of workers' demands for salary and rights protection, or the difficult to determine right and wrong in family disputes - these small stories of people's livelihoods that happen around us hide the worries and joys of thousands of households, as well as the warmth of legal protection. The laws printed on paper are never cold words, but "heartwarming guides" to solve life problems and illuminate daily necessities. Starting today, this newspaper will launch a column titled "Analysis of Livelihood Cases". Here, we tell stories of people's livelihoods that are loved and enjoyed by the common people, integrating the rule of law into daily life, and warming thousands of households with justice. Please stay tuned. There are no trivial matters in family disputes. A single verdict may resolve a case, but it may not necessarily heal the cracks in the family. Recently, the All China Women's Federation, the Ministry of Justice, and the Supreme People's Court jointly released a batch of typical cases of marriage and family dispute mediation, covering multiple areas of livelihood concern such as marriage, child rearing, support, and inheritance. Among them, a case in Zhejiang that relied on digital platforms to resolve divorce disputes is particularly noteworthy - it not only helped a couple who impulsively divorced reconcile, but also vividly demonstrated the digital practice path of the "Fengqiao Experience" in the field of family trials in the new era, providing a replicable sample of people's livelihood for solving "family disputes and resolving difficulties". Ten years ago, Wang (female) and Li (male) entered the marriage hall hand in hand, and the birth of their daughter Xiaohua (pseudonym, 6 years old) after marriage filled this small family with laughter and joy. However, as the child gradually grew up, the differences in parenting philosophy between the two became increasingly prominent due to a long-term lack of effective communication, and arguments became commonplace. In 2023, disappointed Wang filed a lawsuit to the court, requesting a divorce order. At that time, Li also agreed to divorce under emotional pressure. The first instance court then ruled to allow the two to divorce, with Wang directly taking care of their daughter and Li paying monthly child support. I thought this marriage would come to an end, but after the first instance verdict, Li appealed to the Intermediate People's Court of a certain city in Zhejiang with regret and anxiety. He admitted that agreeing to the divorce was an impulsive act and that the marital relationship had not completely broken down; What worries him even more is that after the divorce, his daughter Xiaohua's academic performance declined and her personality became introverted and sensitive. "I don't want my child to grow up in a broken family," he said. In the second trial, the presiding judge keenly noticed that Wang was also hesitant about the decision to divorce. Obviously, the core conflict between this couple is not an irreconcilable conflict of interests, but rather the opposition in parenting concepts caused by the lack of companionship and poor communication. How to build a communication bridge, guide both parties to put themselves in others' shoes, and find a balance between parenting and interpersonal relationships has become the key to the second instance mediation work. To substantially resolve disputes, the second instance court has launched a multi cross collaborative mediation model of "court+women's federation" based on the integrated application of "protecting family safety with the law". Through the platform's diversified family mediation module, we accurately match senior family mediators selected by the Women's Federation and create a relaxed environment for both parties to communicate openly through online and offline linkage. In the mediation room, Wang finally revealed his feelings: "I don't really want a divorce, I just can't stand him playing with his phone when he comes home, ignoring his child's studies and life. I just want his understanding and support." On the other hand, Li's eyes turned red as he looked at his daughter's photo. He admitted that he neglected his family responsibilities and felt helpless about how to repair the parent-child relationship and salvage the marriage. After finding out the crux of the contradiction, the mediator starts from the sweet past of their love and marriage and guides them to recall the ten years they have gone through together. At the same time, the court established a digital growth record for Xiaohua through the "Protecting Family Safety with Law" module for caring for minors, and invited a professional psychological counselor appointed by the Women's Federation to have a safe and private video exchange with Xiaohua. In the video, Xiaohua's immature paintbrush draws a picture of "a family of three holding hands" and softly says, "I hope my dad can play with me more and not always be harsh on me; I hope my mom won't argue with my dad." This painting and the child's wishes are like a heavy hammer, awakening the couple who are immersed in negative emotions, and their opposing attitudes instantly soften. The painting awakens the original intention of the couple, and unraveling the knot between the parties is only the first step. How to repair the family function from the root and avoid the recurrence of conflicts has become the top priority of mediation work. In response to the crux of the conflict in parenting concepts and the imbalance of family responsibilities between this couple, the "Law Protecting Family Safety" family education guidance module has played a key role. The platform intelligently matches family education mentors provided by the Women's Federation based on the actual situation of both parties, and customizes personalized guidance plans. The mentor not only recommends a series of courses on emotional management and scientific parenting to Wang and Li online, but also tracks their learning progress in real time and provides feedback on the problems they encounter in parenting practice. The digital closed-loop management of "course learning practice feedback precise adjustment" has gradually taught couples how to effectively communicate and share parenting responsibilities together. Li took the initiative to put down his phone and accompany Xiaohua to do homework and play games; Wang also learned to empathize and patiently listen to her husband's thoughts. After two weeks of coordination, communication, and professional guidance, Wang and Li finally reached a settlement agreement: voluntarily withdraw the divorce lawsuit and continue to jointly manage the family; Li promised to allocate work and family time reasonably and take the initiative to undertake household and parenting responsibilities; Both parties also agreed to continue participating in family education guidance for 6 months on the "Legal Protection of Family Safety" platform to consolidate the mediation results. Now, after follow-up visits by the court and the Women's Federation, the marital relationship between Wang and Li has become more stable. When encountering differences of opinion, they can listen calmly and express themselves rationally; Xiaohua's face once again bloomed with a brilliant smile, her personality became cheerful and confident, and the quality of homework completion also improved significantly. The "Digital Protection of Family Reunion" family case involves identity relationships and emotional entanglements, which are different from ordinary property disputes and cannot be simply judged. ”The presiding judge stated that the successful mediation of this case was due to the court's in-depth analysis of the core demands of the parties, placing the protection of the rights and interests of minors as the top priority. Through multi cross collaboration and digital empowerment, the goal of "case closure, matter resolution, and harmony" was achieved. Professor Dan Shuhua from the Law School of China Women's University commented on this case, stating that it is a vivid practice of implementing the principle of being most beneficial to minors in divorce disputes. The second instance court, supported by digital technology, not only accurately locates the root cause of conflicts, but also innovatively introduces professional forces such as psychological counseling and family education guidance, taking the wishes of underage children as the core anchor point for dispute resolution, effectively bridging family differences. Behind this case lies a profound shift in the philosophy of family trial work, from "one piece of judgment" to "diversified mediation", from "offline commuting" to "cloud based dispute resolution". The mediation mechanism of "digital empowerment+multi cross collaboration" not only provides an efficient and convenient new path for resolving marriage and family disputes, but also safeguards the harmony and peace of thousands of households with warm justice, injecting warm legal power into grassroots social governance.
