The State Administration for Market Regulation recently issued the "Opinions on the Criteria for Determining the Serious Circumstances of Product Quality Inspection Institutions Falsifying Inspection Results or Issuing False Certificates", clarifying that it belongs to the "serious circumstances" stipulated in Article 57 (1) of the Product Quality Law of the People's Republic of China, including: those who are held criminally responsible for forging inspection results or issuing false certificates that constitute a crime; Having received one administrative penalty for forging inspection results or issuing false certificates within two years, and committing similar illegal acts; In key areas related to people's life, health, and public safety, such as children's products, road motor vehicles, electric bicycles, fire-fighting products, hazardous chemicals, civilian explosives, building insulation materials, and the implementation of production licenses or mandatory product certification management, issuing more than 2 false inspection and testing reports, or issuing more than 10 false reports in various product quality inspection fields; Causing major or catastrophic quality and safety incidents, or generating adverse social impacts; Other circumstances that should be deemed serious according to law and regulations. For illegal institutions that meet the above conditions, the market supervision department will cancel their inspection qualifications in accordance with the law, and include them in the list of serious violations and dishonesty in market supervision and management according to regulations, and implement cross departmental joint punishment.
