Supreme Court: The number of first instance criminal cases involving environmental resources has continued to decline in the past five years

Recently, the Supreme People's Court held a press conference to introduce the work of serving and safeguarding the construction of a beautiful China and serving the green transformation during the 14th Five Year Plan period. At the meeting, Wu Zhaoxiang, the chief judge of the Environmental Resources Trial Division of the Supreme People's Court, introduced that during the 14th Five Year Plan period, the people's courts have concluded 1.192 million first instance cases of various environmental resources, a decrease of 4.3% from the previous five years, including 141000 criminal cases, 804000 civil cases, and 247000 administrative cases, including 22000 environmental public interest litigation cases. In the past five years, the number of first instance criminal cases involving environmental resources has continued to decline, with 24000 new cases collected in 2025, a decrease of 32.6% compared to 2021. Specifically, in terms of assisting in the fight against pollution prevention and control, we have jointly issued judicial interpretations for handling environmental pollution criminal cases with the Supreme People's Procuratorate, and carried out special rectification actions with the Ministry of Ecology and Environment and other third-party environmental protection service agencies on fraud, motor vehicle environmental supervision, and illegal dumping and disposal of solid waste. We have punished illegal crimes that damage the ecological environment in a "full element, full link, and full chain" manner. In the past five years, 29000 first instance cases related to environmental pollution prevention and control have been concluded, and the number of cases received in 2025 has decreased by 30.8% compared to 2021. In terms of strengthening biodiversity conservation, judicial interpretations on the protection of wildlife resources have been issued, special reports and guiding cases on judicial protection of biodiversity have been released, illegal hunting by drones with "falling arrows" and illegal fishing of aquatic products have been severely punished, and the protection of aquatic biological resources has been strengthened to serve the "ten-year fishing ban on the Yangtze River". In the past five years, 135000 first instance cases related to biodiversity conservation have been concluded, and the number of cases received in 2025 has decreased by 36.4% compared to 2021. While the number of traditional environmental resource cases has significantly decreased, new types of cases involving carbon trading, green finance, and prevention and control of new pollutants have emerged. What measures has the People's Court taken in response to this? The phenomenon of 'one decrease and one increase' reflects the phased effectiveness of China's ecological environment protection work and the dynamic adjustment of governance priorities. The environmental and resource adjudication work has ushered in new opportunities for development, but also faces new and greater challenges. ”Regarding the question from People's Daily Online, Liu Xiaofei, Deputy Chief Judge of the Environmental Resources Trial Division of the Supreme People's Court, stated that the People's Court fully utilizes the green principles of the Civil Code to guide judicial decisions. Article 9 of the Civil Code stipulates the principle of green. According to this principle, the people's court considers resource conservation and environmental protection as important factors in applying laws and making judgments when adjudicating civil cases. For example, in recent years, with the entry of new energy vehicles into thousands of households, disputes have occurred in many places due to property companies not cooperating with owners to install charging stations in parking spaces. The People's Court accurately applies the green principle and clarifies that property management companies shall not refuse to cooperate with owners in installing charging piles due to lack of contractual agreement, demonstrating the People's Court's support for the green transformation of production and lifestyle. During the 14th Five Year Plan period, the Supreme People's Court issued 27 guiding cases and 34 batches of 271 typical cases, including new fields and types of cases. Liu Xiaofei gave an example. In the Shanghai court's trial of the green restructuring case of the Yangtze River Mouth Wharf Company, the people's court recognized the environmental governance costs as a common interest debt to be repaid by the bankruptcy property at any time, successfully introduced an investment of more than 87 million yuan, and regarded environmental pollution control as an important consideration factor in realizing the value of the restructuring. Together, they promoted the source control of pollution reduction and carbon reduction in the Yangtze River Basin and the green and low-carbon transformation of enterprises, establishing the judgment rules for green bankruptcy. Liu Xiaofei stated that in the next step, the People's Court will study and clarify the scope of environmental and resource cases, incorporate new types of cases such as carbon emission rights and other environmental rights pledges into the field of environmental and resource trials, use green judicial concepts, rules, and procedures to handle cases well, and maximize support for comprehensive green transformation system innovation.
