This year marks the tenth anniversary of the implementation of the Anti Domestic Violence Law. On March 30th, it was learned from a press conference held by the Supreme People's Court that since the implementation of the Anti Domestic Violence Law, the people's courts have issued a total of 33000 personal safety protection orders. On that day, the Supreme People's Court also released four typical cases of anti domestic violence, clarifying the criteria for identifying domestic violence and highlighting the mandatory nature of the personal safety protection order system. In the case of Zhang's violation of personal safety protection order and judicial detention, Zhang once again physically assaulted the applicant and their close relatives at their home after receiving the order, and harassed and threatened them through text messages. After receiving and handling the alarm, the public security organs promptly reported the relevant situation to the court. The court decided to detain Zhang for 15 days in accordance with the law, resolutely punish his "knowing the law and breaking the law" behavior, and allow the personal safety protection order to "grow teeth". Compared with physical harm, mental harm is concealed, diverse in form, and the consequences of harm are difficult to assess intuitively. In the divorce dispute case between Zhao and Zhang, Zhang treated his spouse Zhao with insults, verbal abuse, and defamation for a long time, resulting in the victim's mental autonomy and lack of freedom, which formed control over him. The people's court ruled to approve the divorce and ordered Zhang to pay Zhao the corresponding divorce damages. In the case of Wang's application for a personal safety protection order, Zhao restricted his spouse Wang from talking to other members of the opposite sex without any evidence, and did not allow Wang to participate in any activities with the opposite sex, resulting in Wang being unable to engage in normal social interactions. The people's court breaks the "hidden cage" constructed by domestic violence perpetrators through "soft violence" and protects the legitimate rights and interests of victims by adjudicating relevant cases in accordance with the law. In addition to physical and mental abuse, economic control is also a form of domestic violence. In the case of Chen's application for personal safety protection order, Liu exerted economic control on his spouse Chen, who had physical disabilities and no independent source of income, by restricting normal medical treatment and other means, forcing Chen to obey his will. At the same time as issuing a personal safety protection order in accordance with the law, the people's court, together with relevant local departments, conducted a risk assessment to assist Chen in receiving employment training, enabling him to have the ability to rely on labor to obtain a certain economic income. This not only treats domestic violence as a "disease", but also prevents domestic violence from happening again, forming a three-dimensional protection. (New Society)
