On March 30th, the Ministry of Water Resources held a press conference on the effectiveness of water conservancy rule of law construction. Vice Minister of Water Resources, Zu Leiming, introduced at the conference that during the 14th Five Year Plan period, water conservancy departments at all levels have made strengthening institutional mechanisms and rule of law management one of the implementation paths to promote high-quality development of water conservancy and ensure water security in China, focusing on the strategic deployment of comprehensive rule of law in water conservancy. The comprehensive promotion of water conservancy rule of law construction has achieved unprecedented results. It is reported that during the 14th Five Year Plan period, China's water conservancy legislation achieved historic achievements. At the national level, a total of 17 laws, administrative regulations, and departmental rules have been issued, surpassing any previous period. Among them, implementing the national "River Strategy", drafting and issuing the Yangtze River Protection Law and the Yellow River Protection Law; Focusing on key businesses such as groundwater, water conservation, water supply, and water engineering, we have formulated and issued six administrative regulations including the Groundwater Management Regulations, Water Conservation Regulations, and Water Supply Regulations, as well as nine departmental regulations. At the same time, the Ministry of Water Resources has participated in promoting the promulgation of the Ecological Environment Code, with water resources, rivers and lakes, and soil and water conservation separately included in the Ecological Environment Code. Promote the revision of the Water Law and Flood Control Law to be included in the national legislative plan. At the local level, focusing on key tasks such as river and lake chief system, water network construction, and prevention of water and drought disasters, 132 distinctive local regulations and rules have been issued at the provincial level. At present, there are 6 laws, 21 administrative regulations, 1 judicial interpretation, 55 departmental rules, and over 1000 local regulations and rules in the field of water conservancy, forming a relatively complete legal and normative system for water conservancy. During the 14th Five Year Plan period, water conservancy law enforcement will be systematically reshaped - establishing a mechanism for linking water administrative law enforcement with criminal justice, and collaborating with public interest litigation through prosecution, continuously improving cross regional and cross departmental law enforcement mechanisms; Improve the rules and regulations on water administrative penalties, law enforcement statistical investigations, and discretionary power benchmarks, formulate a guidance catalog for law enforcement matters, and publish a catalog of administrative inspection items related to enterprises; Strengthen regular law enforcement, carry out special law enforcement on river and lake safety, flood prevention and security, water resource protection, etc., and investigate and deal with a total of 107200 water related illegal cases nationwide, ensuring stable and improved water order. In addition, the legal administration in China's water conservancy field has been comprehensively improved. The legal review has been comprehensively strengthened, and the Ministry of Water Resources has carried out a total of 632 reviews of the legality of various major decisions and documents. Continuous optimization of administrative approval, issuance of a list of water conservancy administrative licensing items, promotion of the implementation of the "separation of certificates and licenses" and electronic reform, establishment of a "water conservancy office" mobile terminal, and 97% of business volume achieved "mobile office". Effectively resolving administrative disputes, adhering to and developing the "Fengqiao Experience" of the new era, achieving "zero tolerance" for inter provincial water disputes, and fundamentally reversing the frequent occurrence of water disputes; 218 cases of administrative reconsideration and litigation were handled, and the results of reconsideration and litigation were used to issue recommendations to the national water conservancy system, promoting the prevention and reduction of administrative disputes from the source and standardizing administrative behavior. Zu Leiming stated that during the 15th Five Year Plan period, the Ministry of Water Resources will anchor the goal of promoting high-quality development of water conservancy and ensuring China's water security, strengthen the legal system of water conservancy, comprehensively promote water conservancy legislation, law enforcement, legal education, and law based administration, and provide more powerful legal guarantees to ensure decisive progress in the basic realization of water conservancy modernization.
