Guidelines for Medical Advertising Recognition Released

The State Administration for Market Regulation, the National Health Commission, and the State Administration of Traditional Chinese Medicine jointly released the "Guidelines for the Recognition of Medical Advertisements" on the 13th, providing clearer and more operational guidance for effectively cracking down on illegal medical advertisements. The guidelines released this time address the issue of unqualified "black hospitals" and "black doctors" misleading the public's choice of medical treatment through advertising, focusing on the concentrated social feedback. They answer the question of "what is medical advertising" and strictly limit the entities that publish medical advertisements. They clearly stipulate that except for legally established medical institutions, no unit or individual may publish medical advertisements on their own or entrust others to do so. How to distinguish "medical advertising" from "medical information disclosure" and "health science popularization"? The guide proposes more operational regulatory rules, clarifying which forms of medical information disclosure and science popularization activities do not constitute advertisements, while listing specific situations where medical advertisements are indirectly published through medical information disclosure and medical health science popularization. It also makes institutional arrangements for the transfer of clues and situation notifications between market supervision departments and health and other departments. (New Society)
